TERMS OF BUSINESS
TERMS AND CONDITIONS OF BUSINESS

ENTIRE AGREEMENT
This agreement contains the entire understanding between Adrielle Serra trading as Adrielle Serra Photography and the Bride and Groom. It replaces any prior agreements that may have been made.

TERMS
It is mutually agreed that the following terms and conditions form an integral part of this contract/invoice and that no variation or modification of this contract shall be effective unless accepted by Adrielle Serra Photography (also called “the Photographer”) in writing.

CONFIRMATION
A signed wedding contract and deposit are necessary to confirm the stated wedding services from Adrielle Serra Photography

PRE-WEDDING CONSULTATION
The bride and groom will outline in detail their specific requirements and Adrielle Serra Photography will advise on planning, logistics and timings where needed. The bride and groom may request an additional consultation closer to the wedding to confirm the remaining details. Adrielle Serra Photography will contact you by telephone in the week before the wedding to ensure that there have been no last minute changes.

PAYMENTS
The balance of the payment for the services contracted for must be paid for 30 days before the wedding date. Payment for additional photographs and albums is made when these are ordered. Any bank charges incurred due to returned cheques will be debited to the Client.

COOPERATION
The bride and groom and Adrielle Serra Photography consent to cooperate and communicate with each other to achieve the best possible result within the understanding of this contract. We recommend that the wedding photographer be provided with a helper (usually the best man) who will point out key individuals to be photographed. The photographer may also require the assistance of the best man in organising family groups. The bride and groom also agree to give the photographer sufficient warning of key events at the wedding to give the photographer time to prepare e.g. bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at wedding like having their photo taken. In such cases the wedding photographer will use his discretion but cannot be held responsible for a lack of photos of these people and as a Wedding is a dynamic event no particular shot is guaranteed.

WEATHER AND/OR DELAYS
Weather permitting, the photographs will be taken as agreed. In the event of inclement weather the photographer, in co-operation with the Client, will make the necessary changes to the schedule and will do her best to produce coverage of the wedding within the time allocated to her. Similarly, when delays occur due to circumstances outside her control, the photographer will stay on beyond the agreed time but may charge a small additional fee for extra time involved.

THE SCHEDULE
The shooting schedule, style of working and experience are designed to achieve a set of wedding photos for the bride and groom to enjoy for years to come, accomplished with good humour and enjoyed by all concerned. The bride and groom and Adrielle Serra Photography therefore agree that punctuality and cooperation are essential to producing outstanding photographic results. In cases where the wedding does not run on time (for example, extreme lateness by the bride arriving to the church) Adrielle Serra Photography cannot guarantee to take the complete set of photos, but in such circumstances will do our absolute best to compensate.

REQUESTED PHOTOGRAPHS
Adrielle Serra Photography will honour requests for specific photographs subject to the following: weather and time permitting; availability and the co-operation of the person(s) concerned.

COVERAGE
Adrielle Serra Photography cannot be held responsible for the lack of coverage caused by the bride, bridegroom or other members of the wedding party not being ready on time, nor by restrictions placed on the photographer by officials of the church, register office or licenced marriage venues. Adrielle Serra Photography does not guarantee any specific picture nor to include any specific background, location, props, or arrangement, although every effort will be made to interpret the Client’s wishes. Adrielle Serra is limited by the guidelines of the ceremony official or reception site management. The Client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is the Client’s responsibility. Adrielle Serra Photography will offer technical recommendations only.

PAPARAZZI WEDDING GUESTS
The majority of your guests will have digital cameras and those guests will want to photograph the bride and groom. In the spirit of cooperation the bride and groom agree to give the photographer precedence in order to take the photographs required for the wedding services described above. We cannot be held liable for a lack of wedding photos if the photographer’s work is interrupted. We would further request the Bride & Groom’s assistance in ensuring that we have time alone when taking those special unique shots.

HOUSE RULES
The photographer is sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example, some ministers insist that no flash photography is allowed, and others will insist that the photographer shoot from a specific location. In such circumstances the bride and groom agree to accept the technical limitations that may be imposed on the equipment used. We advise the bride and groom to make themselves aware of the rules of the venue concerned and if necessary negotiate with the people concerned.

The Photographer will not tolerate verbally or physically abusive behaviour, nor will they share their time or compete with guest photographers for the attention of the subjects. If the Client is unable to control the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of the photographer, it will result in the early or immediate departure of the photographer. The Client understands that in such an event, no refunds will be granted.

COPYRIGHT LAW
English Copyright Law states that the copyright of photographs remains with the photographer. A licence of your wedding photos is given to the bride and Groom upon full payment under the following conditions. The digital images taken by Adrielle Serra Photography are for personal use by the bride and groom and their friends and relatives. If any party wishes to sell the wedding photos for profit, permission must be sought from Adrielle Serra Photography.

ORIGINAL FILES
All image files captured by Adrielle Serra Photography are in RAW format to ensure high image quality. No RAW files will be given to Client under any circumstances whatsoever. These files are large in size and require specialized software to view and edit, Client will receive a selected amount of images in JPEG format only.

MODEL RELEASE
The Bride and Groom grant Adrielle Serra Photography and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the bride and groom for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. Any requests not to publish or use photos for promotional material will be sensitively considered.

LIMIT OF LIABILITY
If the photographer is too ill or becomes injured and cannot supply the wedding services specified above, Adrielle Serra Photography will do everything possible to book a replacement wedding photographer. Please note that the business covers in excess of 30 wedding and portrait events a year and to date this has never happened. If a replacement photographer cannot be found in these circumstances, liability is limited to a refund of any payments received. Adrielle Serra Photography have working methods in place to prevent the loss or damage to your images. However, there exists a small possibility that images may be lost, stolen or destroyed for reasons beyond the control of Adrielle Serra Photography. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of original images supplied.

BOOKING FEES
A booking fee of between £50.00 to £195.00 is required to secure the date. Dates are reserved only when the booking fee is paid. This sum will apply towards the contract fee.
In the event of the bride and groom cancelling the wedding for whatever reason the booking fee is non-refundable. It will be considered as liquidated damages.

FINAL IMAGES
We present you with all images taken at your wedding which meet our quality standards. We are the sole and final judge of those standards and any images which fail to measure up to those standards are permanently discarded. This includes, but is not limited to, out of focus images, accidental camera firings, images ruined by the camera flashes of others, interference of any kind by “non-official photographers” and images with other quality defects.

COLOUR MATCHING and SIZES
Owing to photochromatic anomalies caused by a combination of certain dyes and materials, especially in man-made fibres, it is sometimes impossible to record on camera the exact colour of materials as perceived by the human eye. When processing images, Adrielle Serra Photography will endeavour to achieve a pleasing overall colour balance based on natural flesh tones. It is understood that some colours may not remain consistent throughout a set of photographs owing to variations in lighting conditions. It is also understood that all photographic printing is undertaken within the technical limitations of the process and that colour may not be identical over the whole range within a subject. The colour balance of prints made at different times or in varying sizes may also be variable. Due to the limitations of computer monitors it is understood that images may appear differently according to the specification of each monitor and that prints will not match images rendered on any particular computer monitor.

VIEWING & PROOFING
Photos are normally ready for viewing at the proofing stage between 21-28 days after the event. The bride and groom will be able to view these photos in their own online gallery at www.adrielleserra.co.uk. If requested as part of the wedding package the final selection of photos have been chosen the photographer will design these into the album and produce a PDF file for final proofing by the bride and groom. A maximum of two edits will be included. Any extra edits will be charged at the current hourly rate. Once this has been agreed it will be sent to the Album manufacturers for completion. No further editing can take place after this time and the full cost of the album will be liable and any further changes requested will incur extra costs.

DELIVERY TIMES
Online Photographs: Photographs will be uploaded to your online gallery within 28 days from the wedding day (this may be longer in peak periods).
USB: USBs will be delivered within 28 days from the wedding date (this may be longer in peak periods).
Albums: Albums Canvas’ & Photobooks depending on the style and size, will be delivered within 12 weeks from the wedding day.

ONLINE SERVER
The Photographs will be kept on the online server for a maximum of 12 months & it is the responsibility of the Client to ensure the safe keeping and backup of the Photographs once they have been presented to the client. Adrielle Serra Photography has no control over the management of these servers and systems, and the photographer cannot be responsible for technical support issues which are outside of his control.

RIGHT TO CANCEL
Please note the consumers’ right to cancel all contracts within 14 days of ordering, providing that no clearly personalised work or order has already been undertaken by Adrielle Serra Photography on behalf of the client.

CANCELLATION
In the event of the Client cancelling a booking for wedding photography, Adrielle Serra Photography reserves the right to charge a cancellation fee in accordance with the following scale:
£50, (the booking fee), if cancelled more than 12 months prior to the wedding date.
25% of the agreed fee if cancelled between six and twelve months prior to the wedding date.
50% of the agreed fee if cancelled less than 6 months prior to the wedding date.
100% of the agreed fee if cancelled within 30 days of the wedding date.

Should the cancelled wedding turn out to be a postponement, then subject to availability on a new date, monies other than the booking fee may be applied to the new wedding. In the event of Adrielle Serra Photography having to cancel photographing the wedding, due to illness, accident or act of God, any fees paid, including the deposit, will be returned to the Client. In this instance Adrielle Serra Photography will also do her utmost to provide an alternative photographer from her list of professional contacts.

NOTE
For Wedding Album orders, the photograph selection, as detailed above, and the album order must be agreed and submitted within three months of the Ceremony if included in a package. This is due to the pricing structure of the Album suppliers not being under control of Adrielle Serra Photography.
